Wondrs Terms of Use

These Terms of Use ("Terms") govern your access to and use of Wondrs mobile apps, websites, APIs, and related services ("Services").
By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and Accounts
You must:
- be legally capable of entering a binding agreement
- provide accurate account details
- keep your login credentials secure
You are responsible for activity on your account unless caused by our breach.
2. Service Scope
Wondrs provides travel discovery and recommendation functionality. Recommendations are informational only and may change at any time.
Wondrs does not guarantee:
- availability, pricing, opening hours, ticket availability, or safety of third-party venues or events
- uninterrupted or error-free service
3. Location and Personalisation
Some features require location access and preference data to personalise results. By using those features, you consent to processing described in the Privacy Policy.
You can disable location permissions in device settings, but some features may not work.
4. Paid Features and Subscriptions
If paid features are offered:
- billing is handled by the applicable app store provider unless stated otherwise
- renewals, cancellations, refunds, and payment disputes are governed by the store terms and applicable law
- entitlement fraud or misuse may result in suspension of paid access
5. Acceptable Use
You must not:
- use the Services unlawfully
- interfere with service security, reliability, or performance
- scrape, exfiltrate, reverse engineer, or automate abusive traffic
- upload malicious content or attempt to bypass safeguards
6. User Content
If you submit user content, you retain ownership but grant Wondrs rights needed to operate the Services.
7. Third-Party Services
The Services may rely on third-party providers (for example mapping, places, events, AI enrichment, app stores, payment rails). Wondrs is not responsible for third-party systems, content accuracy, or outages.
Links to third-party websites are provided for convenience only.
8. Intellectual Property
Wondrs and its licensors own all rights in the Services, excluding user-owned content. You receive a limited, revocable, non-transferable licence to use the Services for personal, lawful use.
9. Privacy
Your use of the Services is subject to the Wondrs Privacy Policy.
10. Suspension and Termination
Wondrs may suspend or terminate access for:
- material breach of these Terms
- unlawful or abusive conduct
- security, fraud, or integrity risks
You may stop using the Services at any time.
11. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available". We disclaim implied warranties except those that cannot be excluded by law.
12. Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies rights that cannot be excluded under law, including the Australian Consumer Law ("ACL").
Subject to that:
- Wondrs is not liable for indirect, incidental, special, consequential, or punitive damages
- Wondrs' aggregate liability for claims arising out of or relating to the Services is limited to AUD $100 or the amount paid by you to Wondrs in the preceding 12 months, whichever is greater
Where liability cannot be excluded under the ACL, remedies are limited to those permitted by law.
13. Indemnity
To the extent permitted by law, you indemnify Wondrs and its related entities against claims, losses, and costs arising from:
- your misuse of the Services
- your breach of these Terms
- your infringement of third-party rights
14. Changes to Services or Terms
Wondrs may update the Services and these Terms from time to time. For material changes, Wondrs will provide reasonable notice.
Continued use after the effective date of updated Terms constitutes acceptance.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia. You and Wondrs submit to the non-exclusive jurisdiction of the courts of that place and appellate courts.
